Software Licence Agreement

Molten Sequencer ("the Software") is Copyright © 2008 by Two Floors Records, all rights reserved.

You should carefully read the following terms and conditions before using Molten Sequencer. Unless you have a different licence agreement signed by Two Floors Records, your use of this software indicates your acceptance of this licence agreement and warranty.  If you do not accept these terms you must cease using this software immediately.

Evaluation and Registration

This is not free software.  You are hereby licenced to use the Software for evaluation purposes without charge for a period of 30 days.  If you use the Software after the 30 day evaluation period a registration fee as described in the documentation is required.  Unregistered use of the Software after the 30-day evaluation period is in violation of Australian and international copyright laws.

One registered copy of the Software may either be used by a single person who uses the software personally on one or more computers, or installed on a single computer used by multiple people, but not both.

An organization may purchase a multi-user site licence amounting to either the number of individuals who have access to the Software on any number of computers, or the number of computers that will access the Software by any number of individuals.  A site is defined as all company locations within a 100 kilometre radius. Site licences do not cover subsidiary companies, or customers of a company.

Distribution

Provided that you do not include your Licence Key you are hereby licenced to make copies of the Software; give exact copies of the original to anyone; and distribute the Software in its unmodified form via electronic means.  You are specifically prohibited from charging for any such copies.

Governing Law

This agreement shall be governed by the laws of the State of Victoria, Australia.

Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.  ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO REFUND OF PURCHASE PRICE.

Two Floors Records is committed to protecting your privacy.  We do not sell, trade, or rent your personal information to others.  Our website is structured so that you can visit and download trial software without identifying yourself or revealing any personal information.

If you choose to provide us personally identifiable information (any information by which you can be identified), you can be assured that it will only be used to support your customer relationship with Two Floors Records.

IF YOU ARE UNDER 13 YEARS OF AGE you are not allowed to participate in the Two Floors Records forums, or to provide any personal information on our site.

Forum Registration

Two Floors Records encourages users who want to participate in the Two Floors Records support forums to register.  In order to register, you must provide us with a username (which does not have to be your real name), password and a valid e-mail address.  This allows us to protect our community from abusive postings and provides a verifiable point of contact should legal questions arise.  At any time, you have the ability to keep your e-mail address hidden from other users by selecting that option within your user profile.

When you register, you have the option of providing some additional information such as occupation, interests, and homepage URL.  This optional information is made available to other bulletin or message board users to foster a sense of community.  If you have any concerns about providing this information, simply leave the fields blank and your registration will still be processed.

Ordering Online

When you place an online order, we need to know your name, e-mail address, phone number, billing address and credit card details.  This allows us to process and fulfill your order and to notify you of your order status.

Our website offers the use of a secure server.  The secure server software (SSL) encrypts all information you input before it is sent to us.  The customer data and orders we collect are protected against unauthorized access.

Mailing List

We occasionally email persons on our mailing list to notify them about new Molten Sequencer releases.  This list will never be sold, traded, or rented to others.  When you place an order with us, we automatically add you on this list.  You can add or remove yourself from this list by visiting our Support page.

Disclosure to Outside Parties

Two Floors Records does not sell, trade, or rent your personal information to others.  Two Floors Records may provide aggregate statistics about our customers, sales, traffic patterns, and related site information to reputable third-parties, but these statistics will include no personally identifying information.  Two Floors Records may release account information to (a) comply with law, (b) enforce or apply the terms of any of our user agreements or (c) protect the rights, property or safety of Two Floors Records, our users, or others.

Your Consent

By using our website, you consent to the collection and use of this information by Two Floors Records.  If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.  Regardless of any changes we make to our privacy policy, we will always use your personal information in accordance with the version of the policy in place at the time you provided your information, unless you give your express consent for us to do otherwise.
